미국로스쿨 유학생의 미국 내 취업 고민, 방법 현실적인 조언 / H1B 취업비자 / 네트워킹

영어를 모국어로 하지 않는 유학생으로 미국 로스쿨에서 JD 과정을 거치는 것은 말로 표현하기 어려울 정도로 힘듦니다.  하지만, 그보다 더 어려운 것이 있으니 바로 학생 비자로 인턴쉽을 하고 졸업 후에 미국에서 취업하고 취업 비자를 받는 것일 것입니다. 로스쿨의 학업량을 어마어마 하고 공부 내용 또한 어렵지만, 노력하면 여전히 재미있게 할 수 있습니다. 그러나 내 마음대로 되지 않는 것이 취업과 미국에서의 취업이라면 신분 해결이죠.

최근에 졸업한 로스쿨에서 연락이 왔습니다. 현재 1L에 있는 중국인 유학생이 도움이 필요하다고 했습니다. 그에게 연락처를 줬고, 곧바로 이메일이 왔습니다. 그는 미국에서 취업이 가능할지, 취업 비자를 받는 방법이 있는지에 대한 문의를 하였습니다.

H-1B 취업비자

일반적으로, F-1 학생 비자로 공부를 마치고 취업하면 H-1B 취업 비자를 신청합니다. 이 비자를 받기 위해서는 회사의 스폰서를 받아야 하고, 스폰을 받아도 매년 정해진 쿼터에 들어가야 하며, 그 방법은 추첨에 당첨되는 것입니다. 취업이 어렵지만, 비자 문제로 한국으로 돌아가는 유학생도 많습니다. 2019년에는 20만 명 이상이 H-1B 취업 비자를 신청하여, 8만 5000명이 당첨되어 42%의 당첨률을 보였습니다.

미국 로스쿨 과 H1B 취업비자

미국 로스쿨 유학생도 예외가 아닙니다. 변호사는 H-1B 카테고리에 포함되며, 로스쿨 유학생들은 이 장벽을 마주하게 됩니다. 제가 다닌 학교의 지역은 외국인 비율이 매우 낮고, 이민 사회가 없는 지역입니다. 따라서, 인터뷰를 보더라도 취업 비자에 대해 설명해야 하고, 실력이 있어야 취업하고 비자 스폰을 받을 수 있습니다. 그러나 그마저도 최종 결과는 추첨 (visa lottery)에 당첨되는 것에 달려있습니다.

미국 로스쿨을 다니기로 결정하고, 미국에 남아 정착하기로 결정했다면, 이러한 신분 체류 문제를 알아야 합니다.

이메일에는 미국 정착에 성공한 여러 사례와 제가 했으면 좋았을 것들을 적었습니다. 그 중에 하나가 바로 네트워킹입니다. 미국 로스쿨 진학을 고민하는 분들이나 미국에서 취업을 고민하는 유학생들에게 도움이 되었으면 합니다.

Happy New Year! I must apologize as there's no precise answer to the best work locations for you. This depends on your personal circumstances and career goals, including where you want to live, what field you want to practice in, and whether you want to work with Chinese immigrants, etc.

If you're considering Minneapolis, Minnesota, it's worth noting that Minnesota or North Dakota are not large immigrant states and may not be familiar with the H1B visa. However, once sponsored by a law office or firm, the H1B visa and immigration process can be faster and easier than in larger states like California or New York. After choosing your desired city, focus on networking.

While there are various ways to secure a job, networking is the most effective method in the U.S. Try to allocate time to build your professional network.

I've observed several foreign lawyers who succeeded in resolving their immigration issues. They consistently interned at the same law office each summer, allowing the attorneys to understand the interns' personalities and work ethics. This also encouraged the attorneys to invest in training the interns. Consider this: once they're comfortable working with you, they won't want you to leave. The goal is to prove your value so they'll want to keep you. A law office won't hire you and sponsor your visa at their own expense without good reason.

Building a strong reputation is crucial in American society. I wish I'd known this sooner. Consistently working at the same law office is a form of networking. Don't hesitate to use your CPT time. Once you've captured their attention, your chances of reaching your goals will increase. I secured my job through networking, similar to the example I mentioned above.
